1. Platform Policy Statement
Menagerie prohibits the listing of certain species categories on the Platform. This policy is a platform safety tool designed to reduce the risk of unlawful listings and to protect animal welfare. It is not a legal compliance guarantee.
Laws governing the possession, sale, transport, import, and export of animals vary widely by species, jurisdiction, and circumstance. A species not listed as prohibited here may still be restricted or unlawful under applicable law. Sellers and buyers bear sole responsibility for independently confirming compliance with all applicable laws before listing, purchasing, shipping, or possessing any animal.
2. Absolutely Prohibited Categories
The following categories are prohibited from listing on the Menagerie Platform under any circumstances:
- Endangered or threatened species listed under CITES Appendix I or the Endangered Species Act (ESA), unless accompanied by verified federal permits and Platform pre-approval;
- Federally prohibited wildlife under the Lacey Act or other applicable federal law;
- Venomous or medically significant animals as specifically designated by Platform policy, including venomous snakes, scorpions, and spiders capable of causing serious injury;
- Invasive species specifically restricted or prohibited under federal or state law, including but not limited to snakehead fish, certain carp species, and fire ants;
- Unlawfully collected or wild-caught native wildlife taken in violation of state or federal wildlife laws;
- Illegal aquatic plants including hydrilla, giant salvinia, and caulerpa taxifolia;
- Agricultural pest insects prohibited under USDA regulations; and
- Any species specifically designated as prohibited by Platform policy updates published from time to time.
3. Restricted at Launch
The following categories are subject to additional restrictions during the Platform's initial launch period:
- Birds: pending compliance review of applicable USDA, USFWS, and state permitting requirements;
- Large constrictors: flagged for compliance review, including Burmese pythons, reticulated pythons, and other species restricted under federal injurious wildlife regulations;
- Wild-caught specimens: require additional seller disclosure, documentation, and Platform review before listing; and
- Certain arachnids: subject to case-by-case compliance review depending on species and jurisdiction.
4. Compliance Note
The rules set forth in this policy supplement, and do not replace, applicable federal, state, local, and international law. Sellers are responsible for legal compliance with respect to each listing regardless of whether the Platform has flagged or approved a listing.
Menagerie may update the list of prohibited and restricted species at any time without prior notice. Sellers are responsible for reviewing current Platform policy before listing.
