1. User Content Ownership

Users retain ownership of original content they submit to the Platform, including photographs, text, videos, and other creative works.

By submitting content to the Platform, users grant Menagerie a non-exclusive, worldwide, royalty-free, sublicensable license to display, host, reproduce, format, and distribute that content in connection with operating and marketing the Platform, as set forth in the Terms of Service.

2. Prohibited Infringement

Users may not upload, post, display, or distribute content that infringes the intellectual property rights of any third party. Prohibited infringing content includes, without limitation:

  • photographs owned by others and used without authorization;
  • copyrighted text, descriptions, or articles reproduced without permission;
  • video content owned by third parties;
  • logos, trademarks, or branded assets used without authorization; and
  • any other protected works reproduced without the rights holder's consent.

3. Platform Content

The Menagerie name, logos, brand assets, platform design, proprietary features, and all other content owned or licensed by Menagerie are protected by copyright, trademark, and other intellectual property laws. Unauthorized reproduction, distribution, modification, or use of Menagerie's proprietary content is strictly prohibited.

4. DMCA Notice and Takedown

Menagerie responds to valid notices of copyright infringement submitted in accordance with the Digital Millennium Copyright Act (DMCA). To submit a takedown notice, please include all of the following:

  • identification of the copyrighted work you claim has been infringed;
  • identification of the allegedly infringing content on the Platform, including the specific URL;
  • your full contact information, including name, address, telephone, and email;
  • a statement that you have a good faith belief that the use is not authorized by the copyright owner, its agent, or the law;
  • a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner; and
  • your physical or electronic signature.

5. Counter-Notice

If you believe that content you submitted was wrongly removed in response to a DMCA takedown notice, you may submit a counter-notice in accordance with DMCA procedures. A valid counter-notice must include your contact information, identification of the removed content, a statement under penalty of perjury that you have a good faith belief the content was removed by mistake or misidentification, your consent to jurisdiction of the federal court in your district, and your physical or electronic signature.

6. Repeat Infringer Policy

In accordance with the DMCA and applicable law, Menagerie will terminate, in appropriate circumstances, the accounts of users who are determined to be repeat infringers of third-party intellectual property rights.
